TERMS & CONDITIONS – QUBA HOME SERVICES PVT. LTD.

Welcome to QUBA Home Services Pvt. Ltd. These Terms & Conditions (“Terms”) govern your access to and use of the QUBA website, mobile application, and all related services (collectively referred to as the “Platform”).

By accessing, registering, or using the Platform, you agree to be legally bound by these Terms. If you do not agree with any part of these Terms, you must refrain from using the Platform.

1. Nature of the Platform

QUBA is a technology-enabled online marketplace that facilitates connections between customers seeking home and personal services and independent third-party service providers (“Service Providers”).

Services available on the Platform include:

  • Home cleaning
  • Beauty & wellness services
  • Electrical services
  • Carpentry
  • Air conditioning services
  • Plumbing
  • Appliance repair
  • Other home-related services

Important: QUBA is not a direct service provider unless explicitly specified for a particular service. The Company acts solely as an intermediary to enable bookings and payments.

Service Providers are independent professionals or businesses and are not employees, agents, partners, or representatives of QUBA.

2. Eligibility to Use the Platform

By using the Platform, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into a binding contract
  • All information provided by you is accurate and complete
  • You will use the Platform in compliance with applicable laws

QUBA reserves the right to refuse service, suspend accounts, or terminate access if eligibility requirements are not met.

3. User Registration and Accounts

To access certain features, users may be required to create an account.

You agree to:

  • Maintain confidentiality of your login credentials
  • Accept responsibility for all activities under your account
  • Provide current, accurate, and complete information
  • Update your information when necessary

QUBA shall not be liable for any loss or damage arising from unauthorized access to your account due to your failure to safeguard credentials.

4. Relationship with Service Providers

Service Providers listed on QUBA:

  • Operate as independent contractors
  • Control how they perform their services
  • Set their working schedules and availability
  • Use their own tools, materials, and expertise unless otherwise stated

Nothing in these Terms shall be construed as creating an employer-employee relationship, partnership, joint venture, or agency between QUBA and any Service Provider.

While QUBA may conduct onboarding checks and basic verification, we do not guarantee service quality, professional competence, timeliness, safety, or legal compliance of providers.

5. Booking and Service Delivery

  • All bookings should be made through the Platform.
  • Customers are discouraged from entering direct arrangements with Service Providers outside the Platform.
  • Service schedules are indicative and may vary due to operational circumstances.

Access Requirements:

  • Safe access to premises
  • Water and electricity availability
  • Hazard-free working environment

Failure to provide suitable conditions may result in cancellation without refund.

6. Materials and Equipment

Unless explicitly included in the service package, customers are responsible for arranging required materials or products. QUBA is not responsible for third-party product defects or warranties.

7. Pricing and Payments

Prices displayed on the Platform may include:

  • Service fees
  • Convenience fees
  • Platform charges / commission
  • Applicable taxes

Payment methods may include UPI, cards, net banking, digital wallets, and authorized payment gateways.

Customers agree to pay the full invoiced amount upon completion of service. QUBA may collect payments on behalf of Service Providers.

8. Taxes and GST

Taxes are applied in accordance with Indian laws. Service Providers are responsible for their own GST obligations where applicable.

9. Cancellation, Rescheduling, and Refunds

Cancellation charges may apply for late cancellations, provider arrival cancellations, or repeated rescheduling.

Refund timelines depend on banking partners and payment gateways.

10. Customer Responsibilities

  • Treat Service Providers respectfully
  • Avoid abusive or unlawful behavior
  • Provide accurate service requirements

11. Damages and Liability

Service Providers are responsible for damages caused by negligence during service delivery.

QUBA’s total liability, if any, shall not exceed the amount paid for the specific service.

12. Platform Circumvention

Customers and Service Providers agree not to bypass the Platform for transactions initiated through QUBA.

13. Safety and Verification

Customers should exercise reasonable caution. Suspicious activity should be reported to authorities.

14. Limited Warranty

Certain services may include limited warranty coverage depending on the category.

15. Intellectual Property Rights

All platform content including logos, software, text, graphics, and trademarks are the exclusive property of QUBA.

16. Third-Party Links

QUBA is not responsible for third-party content, privacy practices, or terms.

17. Suspension and Termination

QUBA reserves the right to suspend accounts for violations, fraud, misuse, or false information.

18. Force Majeure

QUBA is not liable for delays caused by events beyond reasonable control.

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Arbitration seat: Kochi, Kerala.

20. Modifications to Terms

QUBA may update these Terms at any time. Continued use constitutes acceptance.
